Terms of Service

By accessing or using BuiltDiffernt's services, platform, and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

BuiltDiffernt offers four public service levels. Free provides done-with-you campaigns through an online course and community. Generate Leads provides pre-qualified leads through LinkedIn and cold-email outreach for your sales team to manage. Book Meetings provides lead generation and meeting booking without qualification checks. Qualified Show-Ups provides lead generation, qualification and booking of meetings that are qualified and attended, backed by the new-client guarantee described below. Your campaign scope and payment schedule are recorded in your Order Form and Master Services Agreement.

On Qualified Show-Ups, one credit counts only when the prospect attends and meets the qualification criteria agreed before launch. A contact, interested reply or booking alone does not count for that plan. On Book Meetings, the billable outcome is a booking, without qualification checks or an attendance requirement; the Qualified Show-Ups guarantee does not apply. On Generate Leads, the billable outcome is a pre-qualified lead against the lead criteria agreed before launch, handed to your sales team to manage. Your team handles discovery calls, follow-up and closing unless separately agreed in writing.

Each paid public plan has a minimum of 10 outcomes per month and a three-month commitment: leads for Generate Leads, bookings for Book Meetings, and qualified attended meetings for Qualified Show-Ups. Free has no paid minimum. Existing agreed allowances, paid-credit values and any non-cash-refundable bonus allocation remain as recorded in your signed Order Form and Master Services Agreement. Campaign scope, reporting, review cadence and integrations are agreed in writing.

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

You agree not to use the Service to:

• Send unsolicited bulk emails (spam) in violation of applicable laws
• Violate CAN-SPAM, GDPR, CCPA, or other applicable email and privacy regulations
• Harvest or collect email addresses without consent
• Transmit malware, viruses, or harmful code
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorised access to any part of the Service
• Use the Service for any illegal or unauthorised purpose

The Service and its original content, features, and functionality are owned by BuiltDiffernt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without prior written consent.

These ownership provisions do not override transfer or licence rights expressly granted in your signed campaign agreement. Any system installation, documentation, team training, handover, integrations, API access, service levels or post-handover support must be expressly included in your agreed scope. Scope, transfer or licence rights, timing, third-party licences, ongoing costs and payment arrangements must be agreed in writing before purchase. Only the system assets and rights specified in the signed agreement are transferred; a public plan does not automatically transfer ownership of all BuiltDiffernt systems. Existing agreed handover and transfer rights remain unchanged.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display such content solely for the purpose of providing the Service. You represent that you have all necessary rights to grant this licence.

You agree to pay the fees and follow the payment schedule recorded in your Order Form. Current public prices are USD 250 per pre-qualified lead for Generate Leads, USD 750 per meeting booked without qualification checks for Book Meetings, and USD 1,000 per qualified attended meeting for Qualified Show-Ups. At the minimum of 10 per month, the monthly minimums are USD 2,500, USD 7,500 and USD 10,000 respectively, with a three-month commitment for each paid plan. Free course and community access has no paid minimum. Published pricing does not amend an existing signed agreement or its checkout amounts. The billing currency, payment timing and minimum commitment in your Order Form and Master Services Agreement govern your programme.

Existing programme checkouts retain their agreed GBP amounts, deposits and monthly payment schedules. A deposit is part of the agreed payment, not an additional fee. Payments apply on the Billing Dates recorded in your Order Form. Any payment-in-full option or alternative schedule must be agreed in writing. Where a Square checkout charges GBP, other displayed currencies are indicative conversions and your bank rate may differ. Applicable taxes follow your Order Form and Master Services Agreement.

For new clients on Qualified Show-Ups, the first three months of guarantee protection begin at campaign launch, not the onboarding payment date. During this period, no-shows or unqualified calls have their credits restored for replacement meetings, not an immediate cash refund. At the end of month three from launch, any undelivered paid credits are refunded at their agreed value. This covers partial shortfalls as well as no delivery. Qualification criteria, paid-credit values and the reconciliation process are agreed before launch. Bonus credits have no cash refund value. This public-plan guarantee does not apply to Generate Leads or Book Meetings. Existing guarantee rights in a signed agreement remain unchanged. Sales, customers and revenue are not guaranteed.

Fees are otherwise non-refundable except as required by law or expressly provided in your agreed campaign terms. We reserve the right to change published pricing with 30 days' notice; this does not change prices already agreed in a signed Order Form without the written variation required by that agreement.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us.

Closing a website or platform account does not itself cancel a signed campaign agreement or remove its payment commitments, termination rights, replacement-credit rights or refund rights. Those matters are governed by the signed Order Form and the version of the Master Services Agreement it incorporates.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

In no event shall BuiltDiffernt, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

This public revision does not amend an existing signed campaign agreement. Campaign terms, including service scope, payments, ownership and the new-client guarantee, remain governed by the signed Order Form and the version of the Master Services Agreement it expressly incorporates. Any variation requires the written agreement specified there.
